La r\u00e9ponse est claire : oui, d\u00e8s qu'il y a deux propri\u00e9taires ou plus dans un immeuble, la d\u00e9signation d'un syndic est obligatoire selon la l\u00e9gislation belge.<\/strong><\/span><\/p>\n\n\n<p class=\"wp-block-paragraph wp-block-paragraph\" style=\"\">Cette obligation vise \u00e0 garantir la gestion des parties communes et \u00e0 pr\u00e9venir les litiges entre copropri\u00e9taires. Mais quand un syndic est-il n\u00e9cessaire et existe-t-il des exceptions ? Cela peut concerner un petit b\u00e2timent ne comprenant que deux appartements ou un complexe plus grand comprenant des dizaines d'unit\u00e9s. Dans les deux cas, un syndic doit \u00eatre d\u00e9sign\u00e9 pour organiser la gestion.<\/p>\n<\/div>\n<\/div>\n\n\n<h3 id=\"aanstelling-door-de-algemene-vergadering-av\" class=\"wp-block-heading\"><strong><span style=\"--wp--custom--font-size:clamp(20px,2.2vw,22px);\" class=\"has-font  has-inline-font-size\">Nomination par l'assembl\u00e9e g\u00e9n\u00e9rale (AG)<\/span><\/strong><\/h3>\n\n\n<p class=\"wp-block-paragraph wp-block-paragraph\" style=\"\">Le syndic est nomm\u00e9 par <strong><a href=\"https:\/\/openacp.be\/fonctions\/acp-assemblee-generale\/\">l'assembl\u00e9e g\u00e9n\u00e9rale des copropri\u00e9taires (AG)<\/a><\/strong>. C'est un moment important, car l'AG est l'organe o\u00f9 tous les copropri\u00e9taires se r\u00e9unissent pour prendre des d\u00e9cisions. L'AG d\u00e9cide \u00e0 la majorit\u00e9 des voix de la nomination du syndic.<\/p>\n\n\n<h3 id=\"verzekeringen-en-kosten\" class=\"wp-block-heading\"><strong><span style=\"--wp--custom--font-size:clamp(20px,2.2vw,22px);\" class=\"has-font  has-inline-font-size\">Assurances et frais<\/span><\/strong><\/h3>\n\n\n<p class=\"wp-block-paragraph wp-block-paragraph\" style=\"\">Une obligation importante pour le syndic est de souscrire une <strong><a href=\"https:\/\/openacp.be\/gestion-syndic\/assurance-rc-syndic\/\">Assurance responsabilit\u00e9 civile (assurance RC).<\/a><\/strong> Cette assurance couvre les erreurs ou omissions \u00e9ventuelles du syndic. Si le syndic exerce son mandat \u00e0 titre gratuit, les frais de l'assurance seront \u00e0 charge de la copropri\u00e9t\u00e9 (ACP).<\/p>\n\n\n<h3 id=\"duur-van-het-mandaat\" class=\"wp-block-heading\"><strong><span style=\"--wp--custom--font-size:clamp(20px,2.2vw,22px);\" class=\"has-font  has-inline-font-size\">Dur\u00e9e du mandat<\/span><\/strong><\/h3>\n\n\n<p class=\"wp-block-paragraph wp-block-paragraph\" style=\"\">Le mandat d'un syndic dure <strong>au moins un an et au plus trois ans.<\/strong> Le conseil d'administration peut d\u00e9cider de prolonger le mandat, mais cela doit \u00eatre explicitement approuv\u00e9 lors d'une assembl\u00e9e g\u00e9n\u00e9rale.<\/p>\n\n\n<h3 id=\"registratieplicht-bij-de-kbo\" class=\"wp-block-heading\"><strong><span style=\"--wp--custom--font-size:clamp(20px,2.2vw,22px);\" class=\"has-font  has-inline-font-size\">Obligation d'enregistrement aupr\u00e8s de la BCE<\/span><\/strong><\/h3>\n\n\n<p class=\"wp-block-paragraph wp-block-paragraph\" style=\"\">Non seulement le ACP, mais aussi le syndic doit s'enregistrer aupr\u00e8s du <strong><a href=\"https:\/\/www.ipi.be\/kb\/la-profession\/syndic-et-copropriete\/linscription-du-syndic-a-la-bce\">BCE (Banque-Carrefour des Entreprises)<\/a><\/strong>. Cela assure la transparence et un suivi administratif clair.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" style=\"margin-top:var(--wp--preset--spacing--lg);margin-bottom:var(--wp--preset--spacing--lg)\"\/>\n\n\n<h2 id=\"wanneer-is-een-syndicus-niet-verplicht\" class=\"wp-block-heading\"><span style=\"--wp--custom--font-size:clamp(22px,2.8vw,28px);\" class=\"has-font  has-inline-font-size\">Quand un syndic n'est-il pas obligatoire ?<\/span><\/h2>\n\n\n<p class=\"wp-block-paragraph wp-block-paragraph\" style=\"\"><strong>Bien que la nomination d'un syndic soit obligatoire dans la plupart des cas, il existe quelques exceptions. Voici les sc\u00e9narios principaux :<\/strong><\/p>\n\n\n<ol class=\"wp-block-list wp-block-list\">\n<li class=\"is-style-surface\">\n<strong>Pas de personnalit\u00e9 juridique<\/strong> Certaines petites copropri\u00e9t\u00e9s sans personnalit\u00e9 juridique \u00e9chappent aux obligations de la loi sur la copropri\u00e9t\u00e9 (art. 577 du Code civil). C'est souvent le cas pour les immeubles ne comptant que quelques appartements. Cependant, l'absence de d\u00e9signation d'un syndic dans ces situations peut entra\u00eener de graves probl\u00e8mes de gestion et une responsabilit\u00e9 accrue pour les propri\u00e9taires.<\/li>\n\n\n\n<li class=\"is-style-surface\">\n<strong>Propri\u00e9t\u00e9 unique<\/strong> Lorsque qu'une seule personne finit par poss\u00e9der tous les appartements d'un immeuble, le concept de copropri\u00e9t\u00e9 dispara\u00eet. Dans cette situation, la nomination d'un syndic n'est plus obligatoire. Le propri\u00e9taire peut cependant choisir de nommer un administrateur pour g\u00e9rer l'immeuble s'il ne souhaite pas le faire lui-m\u00eame.<\/li>\n<\/ol>\n\n\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" style=\"margin-top:var(--wp--preset--spacing--lg);margin-bottom:var(--wp--preset--spacing--lg)\"\/>\n\n\n<h2 id=\"professionele-syndicus-vs-eigenaarsyndicus\" class=\"wp-block-heading\"><span style=\"--wp--custom--font-size:clamp(22px,2.8vw,28px);\" class=\"has-font has-inline-font-size\">Syndic professionnel c. Syndic propri\u00e9taire<\/span><\/h2>\n\n\n<p class=\"wp-block-paragraph wp-block-paragraph\" style=\"\">Le choix entre un syndic professionnel et un syndic copropri\u00e9taire d\u00e9pend souvent de la taille et de la complexit\u00e9 de l'immeuble. La loi n'exige pas explicitement qu'un syndic professionnel soit n\u00e9cessaire, mais dans <strong>des b\u00e2timents plus grands et plus complexes, ceci est fortement recommand\u00e9<\/strong>Un gestionnaire immobilier professionnel poss\u00e8de l'expertise et l'exp\u00e9rience n\u00e9cessaires pour g\u00e9rer des dossiers complexes, ce qui est essentiel pour les grandes associations de copropri\u00e9taires.<\/p>\n\n\n<p class=\"wp-block-paragraph wp-block-paragraph\" style=\"\">Dans les petits immeubles avec des parties communes limit\u00e9es, un <strong>copropri\u00e9taire agissant en tant que <a href=\"https:\/\/openacp.be\/gestion-syndic\/syndic-benevole\/\">syndic b\u00e9n\u00e9vole<\/a><\/strong>.
